Terms of Use

These Terms of Use govern your access to and use of Scoutmon, an IT asset management platform operated by Scoutmon Pty Ltd. By using the Service, you agree to these terms in full.
1. Acceptance of Terms
By accessing or using Scoutmon ("the Service"), you confirm that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, you must not use the Service.
If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these terms.
2. Acceptable Use
Scoutmon is an IT asset management platform intended for business use. You agree to use the Service only for lawful purposes and in a manner consistent with your organisation's policies and applicable law.
You must not:
- Attempt to gain unauthorised access to any part of the Service or its underlying infrastructure
- Interfere with or disrupt the availability, performance, or security of the Service
- Use automated tools to scrape, crawl, or extract data from the Service without prior written consent
- Resell, sublicense, or otherwise commercialise access to the Service
- Store or transmit unlawful, defamatory, or infringing content
- Use the Service to facilitate any fraudulent, deceptive, or misleading activity
- Introduce malware, viruses, or any other malicious code into the Service
We reserve the right to investigate suspected violations and take appropriate action, including suspension or termination of access.
3. Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials. You must not share your password with others or allow unauthorised access to your account.
You must notify your administrator (and, if applicable, Scoutmon) immediately if you suspect your account has been compromised. We strongly recommend enabling multi-factor authentication (TOTP) on your account.
All actions taken under your account are your responsibility. If you are an administrator, you are also responsible for the accounts you create and manage within your organisation's workspace, including ensuring those users comply with these Terms.
4. Data & Privacy
Asset data, user information, and activity logs are stored securely and are accessible only within your organisation's isolated tenant. Scoutmon does not sell, share, or use your data for advertising purposes.
All data is encrypted in transit (TLS) and at rest. Our full data handling practices are described in our Privacy Policy.
You retain ownership of all data you input into the Service. By using the Service, you grant Scoutmon the right to store and process that data solely to provide and improve the Service to you.
Scoutmon is hosted on infrastructure within Australia and/or the European Economic Area. If your organisation requires specific data residency, please contact us before subscribing.
5. Asset Acknowledgements
When assigned company assets or registered for BYOD (Bring Your Own Device), you may be required to complete an electronic acknowledgement form confirming that you have read and understood your organisation's asset or acceptable use policy.
These acknowledgements are legally binding records. Ensure you read the policy carefully before signing. Signed acknowledgements are stored permanently within your organisation's account and may be used as evidence during internal or external audits.
6. Subscription, Trial & Payment
New accounts begin with a 30-day free trial — no credit card required. At the end of the trial period, continued access to Scoutmon requires an active paid subscription.
Billing
Subscriptions are billed monthly or annually in advance depending on the plan selected. Fees are charged in Australian Dollars (AUD) unless otherwise specified. All fees are exclusive of applicable taxes (including GST).
Cancellation
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period, after which your account will revert to a read-only state. No partial-period refunds are issued for unused time.
Refunds
We consider refund requests on a case-by-case basis for documented billing errors or extenuating circumstances. To request a refund, contact us at [email protected] within 14 days of the charge in question.
Price Changes
We will provide at least 30 days' written notice (via email to account administrators) of any price changes before they take effect. If you do not agree to the new pricing, you may cancel your subscription before the change takes effect.
7. Service Availability
We aim to provide a reliable, high-availability service but do not guarantee uninterrupted, error-free access. The Service is provided "as is" and "as available" without warranty of any kind, express or implied.
Planned maintenance windows will be communicated in advance where reasonably practicable. We target 99.5% monthly uptime but this is not a guaranteed service level commitment.
Scoutmon is not liable for losses or damages resulting from service interruptions, data processing delays, or outages caused by factors beyond our reasonable control, including but not limited to third-party infrastructure failures, natural disasters, or acts of government.
8. Intellectual Property
The Scoutmon platform, including its design, software, trademarks, and content, is owned by Scoutmon Pty Ltd and protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership of intellectual property rights to you.
You may not copy, modify, distribute, reverse-engineer, or create derivative works of the Service or any part of it without prior written consent from Scoutmon.
Your organisation's data remains your property. We claim no intellectual property rights over content you submit to the Service.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Scoutmon Pty Ltd and its officers, employees, and contractors shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising from your use of or inability to use the Service, even if advised of the possibility of such damages.
Our total aggregate liability to you for any and all claims arising under these Terms shall not exceed the total amount paid by you (or your organisation) for the Service in the twelve (12) months immediately preceding the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence or for fraudulent misrepresentation.
10. Termination
We may suspend or terminate your access to the Service immediately and without notice if you breach these Terms or engage in conduct that we reasonably believe is harmful to other users, third parties, or Scoutmon.
You may cancel your account at any time. Upon termination, your data will be retained for 30 days during which you may request a full data export, after which it will be permanently deleted in accordance with our data retention policy.
Provisions of these Terms that by their nature should survive termination (including data ownership, intellectual property, liability, and governing law) shall remain in effect after termination.
11. Governing Law & Disputes
These Terms of Use are governed by and construed in accordance with the laws of the State of Victoria, Australia, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
We encourage you to contact us first to resolve any dispute informally. If you are using the Service from outside Australia, you are responsible for compliance with local laws applicable to your use.
12. Changes to Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify account administrators by email with at least 14 days' advance notice.
Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription.
